Who is eligible to claim compensation from the Settlement?

Pursuant to the Settlement Agreement, the Settlement Class Members are:

  1. Primary Market Sub-Class: All persons and entities, wherever they may reside or may be domiciled, who, during the period February 28, 2013 to November 12, 2015, acquired Valeant’s Securities in an Offering, and held some or all of such Securities at any point in time between October 19, 2015 and November 12, 2015, excluding any claims in respect of Valeant’s Securities acquired in the United States (but not excluding any claims in respect of Valeant’s 4.5% Senior Notes due 2023 offered in March 2015); and,

  2. Secondary Market Sub-Class: All persons and entities, wherever they may reside or may be domiciled who, during the period February 27, 2012 to November 12, 2015, acquired Valeant’s Securities in the secondary market and held some or all such Securities at any point in time between October 19, 2015 and November 12, 2015, excluding any claims in respect of Valeant’s Securities acquired in the United States.

Long Form Notice Packets

The Court has ordered as follows:

  • That copies of the Long Form Notice be emailed or sent via registered mail to the brokers identified in Schedule "B" (the "Brokers") requesting that, WITHIN FOURTEEN (14) BUSINESS DAYS OF RECEIPT OF THE LONG FORM NOTICE, the Broker forward copies of the Long Form Notice to all persons or entities for whose benefit the Broker purchased or otherwise acquired Valeant Securities outside the United States during the periods of February 27, 2012 to February 27, 2013 and October 27, 2015 to November 12, 2015 (the "Beneficial Owners"). The Long Form Notice Packets were sent via registered mail to the Brokers on October 16, 2020.

  • For those Beneficial Owners whose email addresses are known to the Broker, the Broker may forward the Long Form Notice by email within fourteen (14) business days (OPTION A).

  • Where the Broker does not have a valid email address for one or more Beneficial Owners, the Broker may:
    • Email a list of the names and last known addresses of the beneficial owners described above to info@ValeantSecuritiesSettlement.ca within fourteen (14) business days (OPTION B); OR
    • Request sufficient copies of the Long Form Notice to mail to all such Beneficial Owners whose email addresses are not known to them within fourteen (14) business days (OPTION C).

  • The Brokers who elect to send the Long Form Notice to their Beneficial Owners shall send a statement to info@ValeantSecuritiesSettlement.ca confirming that the mailing, by email or regular mail, was made and shall retain their mailing records for use in connection with any further notices that may be provided in the action.

  • Upon full compliance with this provision, the Brokers may seek reimbursement of their reasonable expenses actually incurred and combined with this Order by providing info@ValeantSecuritiesSettlement.ca with proper documentation supporting the expenses for which reimbursement is sought, provided that the Brokers may only cumulatively request up to $25,000.00 CAD in total for the expenses relating to the distribution of the Long-Form Notice to Class Members. If the amounts submitted in aggregate exceed $25,000.00 CAD, each Broker's claim shall be reduced on a pro rata basis.

  • Each brokerage firm must submit its account no later than April 16, 2021 order to be entitled to a pro rata payment.

If you are providing a list of names and addresses (OPTION B) you must:

  1. Compile a list of names and addresses of the beneficial owners described in the table above;
  2. Prepare the list in Microsoft Excel format; AND
  3. Submit this list in Microsoft Excel format via email to info@ValeantSecuritiesSettlement.ca.

Important Note: You may choose to secure your Microsoft Excel list. However, you must provide the password. Please note that we will not accept secured message links (i.e. secure web mail, encrypted email messages).

If you are going to forward the Notice Packet to the beneficial owners by mail (OPTION C) you must:

  1. Request the needed number of copies of the Notice Packet via email to info@ValeantSecuritiesSettlement.ca; AND
  2. Mail the Notice Packets to the beneficial owners within fourteen (14) business days of your receipt of the Notice Packets.

Nominee Claim Submission

If you are a Nominee (institution) submitting a claim on your own behalf or on behalf of other beneficial owners or a claim preparer submitting on behalf of beneficial owners, you must provide the following five (5) documents:

  1. One (1) Claim Form
  2. One (1) Signature Verification Document
  3. One (1) Data Verification Document
  4. One (1) Authorization Document (if filing on behalf of clients or customers)
  5. One (1) Excel Spreadsheet Containing Transactions and Holdings

Important Updates:

Update as of November 28, 2025:

The initial distribution of the Class Settlement Funds has been completed. However, as there were uncashed Class Settlement Funds from the initial distribution, a second distribution payment was issued to approved Claimants who cashed their initial distribution payment and whose pro rata entitlement for a second distribution payment, as per Court-Approved Plan of Allocation, was $50.00 CAD or more, without exception.

All payments to eligible shareholders were sent.

For payments sent via cheque, all cheques must be cashed no later than May 26, 2026, or else they will become stale-dated. Stale-dated cheques will NOT be replaced.
